Welcome to Peak and Pine Retreat (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your use of our vacation rental booking site (“Site”) and the services we provide through the Site. By using our Site and services, you agree to these Terms. If you do not agree with these Terms, you may not use our Site.
1.1 Reservations: When you make a booking through our Site, you agree to pay the total amount specified for the rental, including any applicable taxes, fees, and deposits. A reservation is not confirmed until full payment has been received.
1.2 Deposits: A non-refundable deposit of [50%] of the total booking amount is required at the time of reservation. This deposit will be applied toward your total payment. The remaining balance must be paid in full [7 days] before your scheduled check-in date. Failure to pay the remaining balance by the due date may result in cancellation of your reservation, and the deposit will be forfeited.
1.3 Payment Methods: We accept payments through Stripe. By providing your payment information, you authorize us to charge your payment method for the total booking amount, including any applicable fees, deposits, and taxes.
1.4 Security Deposit: A security deposit of $500-$1000 may be required to cover any damages or extra charges incurred during your stay. This deposit will be refunded within [7] after check-out, provided no damages or additional charges are identified.
1.5 Payment Discrepancies: We reserve the right to charge your payment method on file if any discrepancies arise with the balance that was due upon check-in.
2.1 Cancellation by Guest: Cancellations must be made in writing and sent to info.peakandpineretreat@gmail.com
2.2 Cancellation by Us: In the unlikely event that we must cancel your reservation, you will receive a full refund of all amounts paid, including the deposit. We will not be responsible for any other costs or losses incurred by you as a result of the cancellation.
2.3 Transportation or Acts of Nature: We do not provide refunds for issues related to your personal transportation to and from the property, including circumstances beyond our control such as weather events.
2.4 Lodging: If you need to stay at a different location due to an issue with the property you booked, we will only refund you for the affected time based on the amount you paid for your reservation. We will not cover any out-of-pocket expenses for accommodations outside of our network.
3.1 Chargebacks: By making a reservation through our Site, you agree not to initiate a chargeback with your credit card provider or other payment service provider for any reason. You agree to contact us directly to resolve any disputes or issues with your reservation.
3.2 Disputed Charges: If you initiate a chargeback or dispute a charge with your payment provider, you will be responsible for any fees or costs incurred by us as a result of the chargeback. We reserve the right to take legal action to recover any unpaid amounts, including any fees, costs, or damages associated with the chargeback.
4.1 Guest Responsibilities: You agree to treat the property with respect and to comply with all house rules provided by us or the property owner. You are responsible for any damage caused to the property during your stay, and the cost of repairs or replacement will be deducted from your security deposit.
4.2 Occupancy Limits: The maximum number of guests permitted to stay at the property is not to exceed the limit for each property. Exceeding this limit may result in immediate termination of your rental agreement, and you may be asked to vacate the property without a refund.
5.1 No Warranty: We make no warranties, express or implied, regarding the quality, safety, or suitability of the properties listed on our Site. You assume all risks associated with your stay.
5.2 Limitation of Damages: To the fullest extent permitted by law, our liability to you for any damages arising from or related to your use of our Site or services is limited to the total amount you paid for your booking. We are not liable for any indirect, incidental, or consequential damages.
These Terms are governed by and construed in accordance with the laws of Pennsylvania, without regard to its conflict of law principles. Any disputes arising under or related to these Terms will be resolved exclusively in the courts of Pennsylvania.
We reserve the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting to our Site. Your continued use of our Site and services constitutes acceptance of the revised Terms.
